Why Choose TdD Attorneys at Law?

Navigating the complexities of estate law requires clear, strategic guidance. At TdD Attorneys at Law, our St. Louis trusts attorneys assist clients across St. Louis and Chesterfield, Missouri, in drafting, funding, and managing customized trusts.

Whether you need to establish a revocable living trust, appoint a reliable successor trustee, or integrate a trust into a broader estate plan, our legal team provides dedicated advocacy tailored to your family’s financial goals.

What Is a Trust?

A trust under Missouri law is a fiduciary relationship where a creator (known as the grantor, settlor, or trustor) grants a trustee or successor trustee legal authority to hold and manage assets for designated beneficiaries.

All assets transferred into the arrangement become trust property. The appointed trustee administers and distributes these assets according to the precise terms outlined in the trust agreement.

Common Types of Trusts in Missouri

Estate planning in Missouri utilizes various trust structures depending on your asset protection and tax objectives:

Revocable Living Trust

A revocable living trust allows the grantor to retain control over their assets during their lifetime. You can modify, amend, or revoke the trust at any time while you are competent. Upon your death or incapacity, the designated successor trustee steps in to manage the assets without court intervention.

Irrevocable Trust

An irrevocable trust cannot be easily modified or revoked once established. By transferring ownership of assets out of your personal estate into an irrevocable trust, those assets are generally shielded from estate taxes, lawsuits, and creditors.

Specialized Trust Structures

Depending on your family circumstances, an estate planning lawyer can help you set up specialized trusts, including:

  • Special Needs Trusts: Provide financial support to a disabled beneficiary without disqualifying them from government assistance programs.
  • Charitable Trusts: Transfer assets to non-profit organizations while securing income and tax advantages.
  • Testamentary Trusts: Created through a will and taking effect only after the grantor’s death.
  • Pet Trusts: Ensure dedicated funds and care instructions for pets after your passing.

We thought or old will and plan was up to date, we were wrong. Everything about a trust is what we needed. All done in 5 days. Wills go to probate, trusts don't. Just added trust as secondary beneficiary. Thank you Ted! Great customer service!

Where do I start?! Ted was amazing from beginning to end. After speaking with several attorneys who made getting a beneficiary deed sound incredibly complicated. Ted scheduled me the same week and had everything handled quickly and efficiently; we were in and out in no time.
Beyond his efficiency, what stood out most was his professionalism and kindness. He treats you like a person, not just another transaction and that truly makes a difference. I genuinely appreciate his approach and will absolutely recommend this law firm. I plan to continue to do a business with them moving forward.

Ted was very helpful in setting up our will and trust. My wife and I are in our early 70s and should have done this a long time ago. His cost for this service was very reasonable. We definitely recommend him.

I've worked with these guys on multiple realestate projects now. They're awesome! What they lack in size compared to some big firms, they make up for in brilliant, outside the box, precision. A special thanks to Erik! I would highly recommend this firm to friends and family.

If you need attorneys who will fight for you....look no further. I had a need to get out of a real estate partnership that went sour and needed to get out of a mortgage situation that was cumbersome (mostly emotional) to me. Through a referral from a friend I called TdD Attorneys at Law and got a same day initial appointment with Ted Disabato. Ted talked with me, not down to me, and suggested to do a Partition lawsuit. He explained, in detail what it meant, to my satisfaction. After hiring the firm, I was contacted by his associate attorney (Pitbull) Louis Teson. What a fine young man this guy is. He mediated an amicable agreement with my (former) ex partner and the rest is history. Thank you Ted, and thank you Louis. From the bottom of my heart!! P.S. Ted...you need to work on making Louis a Partner. 🙂

Key Steps to Create a Living Trust in Missouri

Creating a legally enforceable trust requires strict adherence to state statutory requirements:

  1. Determine trust structure: Decide between an individual or joint marital trust.
  2. Inventory assets: Identify the real estate, accounts, and investments to include.
  3. Designate beneficiaries: Name the individuals or organizations receiving trust assets.
  4. Appoint a successor trustee: Select a reliable person or institution to manage distributions.
  5. Draft and execute the agreement: Formalize the trust document with legal assistance and execute it before a notary public.
  6. Fund the trust: Re-title deeds, financial accounts, and beneficiary designations into the name of the trust.

Key Benefits of Establishing a Trust

Implementing a trust as part of a comprehensive estate plan offers significant legal advantages:

  • Probate Avoidance: Assets in a trust transfer directly to beneficiaries without court delays or fees.
  • Privacy Protection: Unlike a public will probate file, trust documents remain private.
  • Incapacity Management: Allows your named successor trustee to manage finances if you become ill or incapacitated.
  • Asset Control: Enables conditional distributions (e.g., releasing funds when beneficiaries reach specific ages).

¨With a background in business and real estate, I have a strong passion for guiding others through these complex areas of law. I became an attorney to have a positive impact on others. I strive to do everything I can to help my clients find a solution for their unique legal challenges.¨
